Buying, selling, financing or renting your home or other property is a big and very important matter for most of us.  Our office provides a broad range of services to assist you in all aspects of your real estate transactions. 

 

When you buy or sell your home, or refinance it, having that transaction closed by a real estate attorney can avoid many problems for you.  Often I will do a closing in which I find some irregularity in the chain of title or procedures used by the closing agent when the property was bought and sold years before.  Those problems can have significant impact many years later if not corrected.  As I write I am assisting a client who sold her home 8 years ago and is now named as a defendant in a foreclosure lawsuit because the people she sold to have defaulted on their mortgage; she is named because the Deed prepared for her by the closing agent 8 years ago is improper! An improper Deed means she still has a potential ownership interest in the house and her interest must be foreclosed; a foreclosure judgment, though she owed no money, will still adversely affect her credit history for years to come!  Real Estate Attorneys are trained to look for problems, not just fill out the forms, and then fix them before the problems come looking for you.

 

Our firm is a one stop shop.  Bring your contract for sale or purchase to me and we take it from there.  We’ll search the title and work with your lender, if financing is involved, to find and fix actual or potential problems and prepare for the big day of closing. We’ll then stand behind our work by issuing Title Insurance; I’m an independent agent of the Old Republic National Title Insurance Company, the largest and financially strongest title insurance underwriter.  

 

If you’re selling your home yourself, talk with me about obligations you have as a seller so that you avoid potential problems.  I’ll also assist with preparing the Contract and do the closing of the transaction.  If you’re providing owner financing I will prepare the appropriate Mortgage and Loan documents for you and the buyer.

 

As a career military officer I had occasion to rent out my homes when I transferred.  I know how difficult being a long distance Landlord can sometimes be.  Let’s talk before you do it.  I can assist you with preparing a lease that protects your interests and meets the statutory obligations you have.  If a problem arises later that requires you to evict a tenant I can assist with that as well.  Likewise, as a Tenant you have certain rights and obligations.  Let’s talk about them and let me review your lease before you sign or advise you if the Landlord has begun or warned of some action against you.

 

Sometimes life takes an adverse turn for us and we face the possibility of Foreclosure.  There are things you can do that may prevent the foreclosure or at least buy you some time while you pursue options.  If you’ve been served with a Complaint for Foreclosure by a Lender, let’s talk.
